Court orders arrest of Ricardo Martinelli

The Supreme Court issued the decision Monday.

It had received four requests to arrest the former president for ordering illegal surveillance during his administration.

The plenum of the Supreme Court Monday ordered the provisional detention of former President Ricardo Martinelli in connection with the investigation into illegal surveillance allegedly carried out during his administration (2009-2014).

After a public hearing, the judges met for nearly four hours before authorizing Judge Jerome Mejía, who is handling the case against Martinelli, to take measures to enforce the order of provisional detention to achieve his participation in the process.

The measure of pre-trial detention, according to the ruling, was adopted based on the declaration by Mejia that Martinelli had been properly notified of a Dec. 11 hearing in the case. After Martinelli failed to appear at that hearing, four requests for his arrest were submitted to the court, one by prosecutor Harry Diaz and the others by lawyers representing victims in the case.

The hearing was presided over by Deputy Chief Justice Luis Ramón Fábrega. Judges Hernán De León, Nelly Cedeño, Harley Mitchell, Oydén Ortega, Abel Zamorano, Wilfredo Sáenz, Secundino Mendieta and Luis Mario Carrasco also participated.

REACTIONS

“We are extremely satisfied," said Carlos Herrera Morán, a lawyer for some of the victims. "It's the first round, but this process should end with the punishment of a person who abused his power."

PRD leader Mitchell Doens, a victim of the illegal surveillance, said the decision "fully adheres to the law."

Fellow PRD leader Balbina Herrera said she hoped that a mechanism is established to bring Martinelli to justice.

"Today, the administration of justice in this country has made progress," she said.

Carlos Carrillo, a lawyer for Martinelli, said that the court has set a precedent that it can order the detention of a person without even being charged.

"Now they can arrest a person without an accusation being made," he said, saying an appeal could be filed before the Inter-American Court of Human Rights. 

The court also rejected a claim of unconstitutionality presented by Martinelli's defense team.
