AG claims to have cooperated with Brazil

Attorney General Kenia Porcell said Wednesday that Panama has not denied information to Brazil on bank accounts related to the construction company Odebrecht.

However, documents revealed by prosecutors in Brazil contend otherwise. They claim that Panama has refused to cooperate with their investigation by failing to respond to questions they submitted 18 months ago.

National Bar Association President José Alberto Álvarez, after a meeting yesterday with the attorney general, said that the request for judicial cooperation carried out by Brazilian prosecutors in the Lava Jato case was not covered by the bilateral treaty signed between the two countries, but within the framework of the Convention on the Fight Against Corruption.

But such an assertion is inaccurate. The legal assistance requests between Brazil and Panama is also governed by two other conventions as well as a treaty on mutual legal assistance signed in 2008.

After the meeting, Alvarez said that the conventions signed by Panama specifically prohibits so-called "fishing expeditions," a term used to describe vague requests for information.

But Brazilian prosecutors were very specific in their requests, as evidenced by the documents that were submitted to Panama 18 months ago and which have been reviewed by La Prensa. The request specifically requests information on the activities of an account at Creditcorp Bank that has been linked to Odebrecht through a confession by a company employee. That account was allegedly used to pay bribes to officials in foreign countries that granted contracts to Odebrecht.

Panama was asked to identify bank accounts that sent or received deposits from accounts related to companies linked to the investigation. It was also asked for other banking records linked to the accounts.
